Kingsland, Georgia

Dealing with a divorce is never simple on any of the parties involved. Aside from having to cope with the loss of one’s union, there is also the separating of assets and properties that you once shared with your former spouse that must be handled. And although many of those items were purchased with the intent of being owned by two individuals, it can often be difficult to allocate certain things without a hitch. Worse than that can be marriages that involve children as battles may ensue over child custody and support.

Issues of visitation, child support and large assets such as your home or vehicles are certainly more pertinent, which is why hiring an experienced attorney is vital. Mark McManus S.E. Ga. Divorce Legal Advice on Child Support:

In 2007 Georgia enacted new child support guidelines that consider the income of both parents. Many factors go into this new computation of child support including rules for when one parent does not work, or is underemployed. Factors such as tips, bonuses, overtime and commission must be considered. Other children in the home and other children being supported are also considered.

Other issues considered include who is paying for health insurance for the children involved, expenses for child care, and travel expenses. Mark has years of experience when it comes to child support and will help you to determine all of the necessary factors involved so the child support amount is fair and in the best interest of the child/children.

Types of Divorce recognized in Georgia:
In the state of Georgia, when the court orders a final divorce, it means that the divorce is permanent. That is, the divorce is final which allows both parties to legally remarry. The divorce also terminates all property claims.

In Georgia, you can get a divorce if there is absolutely no chance in salvaging your marriage. This is referred to as "no-fault" divorce. Most divorces are granted if and when the marriage is "irretrievably broken." In such cases, it is not required to show any wrongdoing or fault.

In terms of an annulment, that is a declaration by a court that a marriage never existed. This is when it states it was never a valid marriage to begin with. It’s rare for courts to grant an annulment, so this isn’t always the best option if you are interested in dissolving your marriage.
Georgia also allows the filing or an action for separate maintenance (a legal separation). This includes all issues of a divorce, except that there is no divorce.

Even though divorce is more common today, many people aren’t familiar with all the legalities that surround it. Mark works with you one-on-one to make sure all your questions and concerns are answered and that you comprehend what each stage in the legal process entails. Painting a picture of your marriage and why divorce is what is best for you and your family will allow Mark to better strategize and executing an immediate plan so he can offer you sound legal advice.
